THIS SITE IS OWNED AND PUBLISHED AND/OR MANAGED AND PUBLISHED BY Dung Beetle LTD. PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY. BY SUBSCRIBING TO THIS SERVICE YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS:

1. INTELLECTUAL PROPERTY RIGHTS IN THE CONTENT OF THE SITE.

Dung Beetle Content

All material on the site is either owned by Dung Beetle Ltd or it licensors, and is protected by copyright and trade mark laws. You may not copy, modify, reproduce, republish, post, transmit or distribute in any way any material from this site including the underlying code and software, save as authorised by this agreement.

You are only authorised to use the site and its contents for your personal, non-commercial use. This amounts to viewing the site and printing off individual pages or sections for personal use.

User Content

Any content provided by you by, for example, posting messages to bulletin boards or chat forums, uploading files, inputting data, or engaging in any other form of communication through this service, although owned by you, is subject to a royalty-free, perpetual, non-exclusive, unrestricted, world-wide licence allowing Dung Beetle ltd to use, copy, sublicense, adapt, transmit, publicly perform or display any such content.

2. DUNG BEETLES OBLIGATIONS

Dung Beetle Ltd will use its reasonable endeavours to ensure that the site and the facilities is/are available at all times and that the Dung Beetle Ltd supplied content on or from the site is true, accurate and error free. However we do not guarantee this and provide no warranties unless specifically stated.

3. USER OBLIGATIONS

You will ensure that all information provided on Registration Forms is accurate and kept up to date by using the "Modify" template as appropriate. You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur through your use of the services, including all activities that take place under your account.

4. DUNG BEETLE LTD RIGHTS

Dung Beetle ltd shall be entitled to discontinue the website services or to disable any particular user's account or access rights at any time with no notice.

Dung Beetle Ltd reserves the right to change any or all of these terms and conditions without prior notice.

5. DISCLAIMER / LIABILITY

Use of the site and the facilities thereon, and any material or information obtained or sent from this site is at your own risk, and Dung Beetle Ltd hereby expressly disclaims, to the fullest extent permitted by applicable law, all warranties, express or implied, of any kind whatsoever including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and infringement. In addition, Dung Beetle ltd shall not be responsible for the failure of performance of this site and/or the software used thereon or obtained therefrom; the loss of data or services resulting from delays, non-deliveries, mis-deliveries, or service interruption; the accuracy, quality or nature of information obtained through its services; nor the consequences arising from or related to any viruses transmitted through its servers, or any liability, costs, loss of profits or consequential losses arising from your use of, or inability to access this site, save that liability for death or personal injury is not excluded.

This site may be linked to or from other sites that are not maintained by Dung beetle Ltd. Dung Beetle Ltd does not control in any respect any information, products or services offered by such other sites and shall NOT be responsible for the content of such other sites. For example, users may be able to buy goods and services via the site, some of which may be through third party retailers who link to the site. Users may also enter into correspondence with or participate in promotions of advertisers on the Site. Dung beetle Ltd in no way endorses these third parties and any such transactions, dealings, correspondence with or participation in promotions of, third parties, including the delivery of and the payment for goods and services and any other terms, conditions, warranties or representations associated with such matters are solely between the corresponding user and the third party. Dung Beetle Ltd assumes no liability, obligation or responsibility for any part of any such transaction, dealing, correspondence or participation.

You agree to indemnify Dung Beetle ltd in respect of any liability or any costs, loss of profits, loss of data, or consequential losses arising from a breach by you of any of the terms of this agreement.

6. JURISDICTION

This User Agreement shall be governed by and construed in accordance with the laws of England and the parties submit to the exclusive jurisdiction of the English Courts.

If any provision(s) of the User Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.

8.PRICE
The Price of any Item purchased pursuant to these Terms shall be the price prevailing at the time you confirm an order as reflected in our price list posted on the Site. All prices shall have Value Added Tax and any other relevant tax added thereto at prevailing rates from time to time.

9.DELIVERY
Delivery of a Item purchased pursuant to these Terms will be made direct to your mobile phone details of which are provided by you at the time of purchase. Delivery is conditional in all respects on the following:
a) Your mobile phone must be set to receive text messages.
b) The Item you order must be capable of being received on your mobile phone.
c) Items can only be sent if your phone is on a compatible mobile phone network, a full list of which is available on the order form.
10.WARRANTY
It is an express condition that any customer purchasing Item through the Site is fully and legally entitled to do so and in the event that you place an order for an Item you hereby warrant and represent that you are over 18 years old and that all information you provide about yourself whether in connection with the purchase of an Item or otherwise is true, accurate, current, complete and not misleading. Dung Beetle Ltd in turn warrants and represents that it has all necessary rights to grant the licence to use any Item sold pursuant to these terms.

11.DISTANCE SELLING
This paragraph sets out those items required pursuant to the EC Directive on Distance Selling (Directive 97/7) as ratified by the Consumer Protection (Contracts Concluded by Means of Distance Communications) Regulations 2000.

b. Description of Goods. The goods sold pursuant to these Terms comprise Items either selected from those available on our Site or created by us to your order.
c. Price. The price of Items purchased via the Site shall be the price advertised on our price list on the Site at the time of purchase together with Value Added Tax and any other relevant tax thereon at prevailing rates from time to time.
d. Delivery Costs. Items are delivered directly to your mobile phone at no additional cost and the price of delivery is all-inclusive within the price of the Item.
e. Payment. Payment for any Item purchased pursuant to these terms from the site must be made by debit or credit card at the time of placing the order and prior to delivery.
f. Cancellation. Due to the nature of the product, the fact that the Item can be previewed or heard prior to purchase and that once sent it cannot be returned there is no right of cancellation, excepting subscription services.
g. Cost of Communicating with Dung Beetle Ltd. There are no premium rate charges which you will incur by reason of communicating with Dung Beetle Ltd. The cost of any such communication will accordingly be limited to the charges you would normally incur for use of the Internet in accordance with personal arrangements made with your Internet service provider and your telephone carrier.
h. Price Validity. The price of Items is fixed at the date of purchase. Future purchases shall be subject to prices prevailing at that time.
Duration of Contract. The right and licence to use an Item sold pursuant to these Terms is perpetual, non-exclusive and irrevocable but limited to use on the mobile phone to which the Item is initially transmitted.

12.REFUND POLICY
Refunds will be given at the discretion of the company's management.
